Terms of Use
Effective 5 November 2026. Plain language, kept short.
1. Agreement
These terms apply to the Clearbay app for macOS ("Clearbay"), its online services (AI explanations and plans, rule updates and licence checks) and this website, all provided by NepTechPal ("we", "us"). By using Clearbay you agree to them. Our Privacy Policy explains what data is used and why.
2. App Store purchases
If you got Clearbay from the Mac App Store, Apple's Licensed Application End User License Agreement (the standard EULA) is your licence for the app and any in-app purchase, including Clearbay Pro. These terms add details about our online services and do not reduce any rights the standard EULA gives you. Payments and refunds for App Store purchases are handled by Apple; request refunds at reportaproblem.apple.com.
3. Clearbay Direct licences
If you use the Direct edition downloaded from this website, we grant you a personal, non-transferable licence to use it on your own Macs. A Pro licence key can be active on up to 3 Macs at a time. Don't share, resell or publish licence keys; we may disable keys that are. Refunds for Direct purchases follow the policy shown at checkout.
4. Your files and backups
Clearbay only acts on items you choose, after you review the plan and click Run. Remove moves items to the Trash. Offload copies items to the drive, bucket or folder you choose, checks the copy, and then removes the original from your Mac.
You are responsible for:
- Keeping backups of anything important, for example with Time Machine. An offloaded copy is a move, not a backup: if the only copy lives on a drive that fails or a bucket you delete, it is gone.
- The storage you choose: its reliability, its terms, and any costs your cloud or storage provider charges.
- Reviewing each plan before you run it.
5. AI explanations
AI explanations and suggested plans are generated by a language model and may be wrong or incomplete. They are labelled as such in the app. Safety labels come from Clearbay's built-in rules, not from AI, and AI cannot select anything the rules don't allow. Treat explanations as a helpful hint, not professional advice, and decide for yourself.
6. Online services and fair use
The AI service has daily limits (larger with Pro) to keep it affordable for everyone. Don't attempt to bypass limits, overload the service, or use it for anything other than Clearbay. We may change limits, or change or stop the online services, for example if a provider changes its terms. Clearbay's core features (scan, Remove, Offload, restore) work without them.
7. Acceptable use
Don't reverse engineer the online services, misuse licence keys, or use Clearbay to break the law or another provider's terms.
8. No warranty
To the extent the law allows, Clearbay is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We work hard to keep your data safe, but we can't promise the software is free of errors or that it will work with every drive, file system or provider.
9. Limitation of liability
To the extent the law allows, NepTechPal is not liable for loss of data, profits or business, or for indirect or consequential damages, arising from your use of Clearbay. Our total liability for any claim is limited to the amount you paid for Clearbay in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you; your statutory consumer rights are not affected.
10. Changes
We may update these terms. If a change is significant, we will update the effective date above and say so in the app or on this site. Continuing to use Clearbay after a change means you accept it.
11. Governing law
These terms are governed by the laws of Nepal, without affecting any mandatory consumer protection law of the country you live in.
